Draft Gambling Legislation Proposed in Albania

In Albania and the government of Prime Minister Edi Rama has proposed legislation that would look to end the nation’s partial five-year prohibition on sports betting and gambling.

The Balkan country of approximately 2.8 million people outlawed all gambling not offered via state-sanctioned casinos in 2018 but now wants to reverse this move as the initial prohibition is believed to have failed in meeting its stated aim of substantially reducing organized crime.

The draft legislation composed by the nation’s Ministry of Finance and Economy would look to establish a regulated online gambling market featuring strict licensing, anti-money laundering and customer compliance directives. The measure’s language would also mandate that iGaming operators accept only digital payments rendered via ‘authorized agents’ such as Western Union or domiciled banks and financial institutions licensed by the Bank of Albania and hold on to punters’ personal data for a minimum of three years.

This measure from the Ministry of Finance and Economy would oblige iGaming operators to only accept wagers from registered players with such firms moreover required to guarantee winnings and keep a minimum of €1.5 million in a ‘designated bank account’ that should ‘never be less than 5% of all deposits made by players in the previous financial year’.

An additional provision of the draft legislation would compel all licensed iGaming operators to register with Albania’s National Business Centre, which is a process set to incorporate a detailed review of all shareholder and management interests so as to exclude those with criminal convictions or facing serious prosecution.

The measure is to furthermore look to establish a special fund to be financed by a 15% corporate income tax on iGaming operators for the support of sports, culture and welfare projects. State institutions are to correspondingly be allowed to pitch for some of this cash so as to top up any existing financing.

In the land-based realm and the draft legislation proposes requiring casino operators to pay a 15% corporate income tax and commit to depositing 0.4% of their annual turnover into this special fund. The measure goes on to suggest that the national lottery should hand over 5.4% of its annual turnover to this peculiar repository.

Albania was home to more than 4,700 gambling shops before the institution of the partial ban in 2018 while the intervening years have seen local law enforcement authorities conduct a number of operations to crack down on illicit wagering. The proposed legislation would also not look to place a limit on the number of licenses issued or accounts that can be simultaneously enjoyed.

Rama’s government declared that the ‘stringent requirements set forth in the law’ would look to ‘promote responsible gambling while discouraging illicit betting activities’ and create an additional revenue stream for a multitude of state-backed programs.

Innovative iGaming content provider Hacksaw Gaming has obtained a B2B gaming license from the Swedish Gambling Authority (SGA).

The agreement permits Hacksaw Gaming to supply its portfolio of content, including favorites Wanted Dead or a Wild, Hand of Anubis, Mines, and Dork Unit, to licensed operators in Sweden, amplifying the studio’s European presence.

Hacksaw Gaming already holds gaming licenses from various regulatory bodies like the Malta Gaming Authority (MGA), United Kingdom Gambling Commission (UKGC), Isle of Man Gambling Supervision Commission (Isle of Man), and Alcohol and Gaming Commission of Ontario (Ontario), while its games are certified in a number of other jurisdictions.

Since regulations took force on March 1, 2023, all online casino game suppliers targeting players in Sweden have been required to tender an application for a B2B gaming license. The new framework is aimed at augmenting the country’s channelisation rates – the degree to which gambling activity is conducted at licensed sites – by protecting the integrity of the market and safeguarding consumers’ welfare.

“The purpose of the licence requirement for gaming software is to discourage illegal gambling,” explained the SGA in 2022, adding: “Unlicensed game operators must not be able to use suppliers who manufacture, provide, install and/or change game software for game operators who have a licence in Sweden.”

Georgia Bans 1.45 Million People from Gambling

A new decree approved last year has banned well over a million people from participating in gambling in Georgia. The law, which follows the introduction of new online casino restrictions, bans under 25s, public employees, the socially vulnerable and those blacklisted by courts from gambling.

Minister of finance Lasha Khutsishvili said 1.45 million citizens are now banned from gambling, including people who are self-excluding. The new law came into effect this month after being approved by prime minister Irakli Garibashvili last year.

Last month, Garibashvili approved another batch of restrictions to tighten the country’s gambling laws. One of the measures will be to ring-fence online casino licences so they can be held only by land-based casinos based in Georgia.

That would make Adjara Group, Crystalbet and Iveria the only operators that can hold online casino licences. However, in addition, the government plans to offer a licence for exclusive rights to operate online casino for a fee of €1.6m.

Last year, the government presented plans to introduce separate gaming licences for specific verticals so that operators would no longer be able to expand into different verticals with no need for an additional permit. The annual permit fees for each of the business types (online casino, slots and betting) were to be set at €35,580.

All gambling advertising on TV, websites and public places has also been banned, and gambling taxes have been raised. Another batch of measures that are expected to be imposed includes a ban on casinos on ships.

The government says the measures are designed to bring the country in line with the EU expectations as it seeks to enter the bloq, although there is no EU ban on gambling advertising or prohibiting certain people from participating.
