Albanian Socialist Party Pulls Gambling Draft Law from Parliamentary Vote

Under the direction of the Speaker of the Assembly, Mrs. Lindita Nikolla, the Assembly convened today in the next plenary session.

Under the conditions of holding an abnormal session, caused by the actions of the parliamentary opposition, the session immediately began with the voting of bills according to the agenda.

The session adopted two bills and two project decisions.

The bill “For an addition to law no. 7651, dated 21.12.1992 ‘On official holidays and memorial days’”, as amended, was approved with 74 votes in favor.

The bill “For some additions and amendments to law no. 155/2015, ‘On gambling in the Republic of Albania’”, as amended, was approved with 72 votes in favor. Also, the respective amendments for this bill were approved with 72 votes in favor.

The project decision “For some changes in the Assembly decision no.127/2018 ‘On the approval of the structure, staff, and categorization of job positions of the Institute of Statistics, INSTAT’”, was approved with 74 votes in favor.

The project decision “For the approval of the organizational structure, staff, and classification of salaries of part-time employees of the Central Election Commission”, was approved with 74 votes in favor.


The Albanian parliament was about to vote to reverse a five-year-old ban on online sports betting as the government admitted that it had failed to control the illegal activity. The proposed draft law, which would permit licensing for ten betting companies with prior experience, was scheduled to be voted on Thursday, February 8, 2024, during the plenary session. However, Bledi Cuci, the Chairman of the Socialist Party, unexpectedly withdrew the said law without providing an explanation.

“At the request of the Socialist Party, it was requested to withdraw from the discussion of the draft law on gambling,” the Speaker of the Parliament, Lindita Nikolla, said. “It was approved with 74 votes in favor.”

Nevertheless, the law on allowing online betting activities in Albania shall be returned for a vote in the parliament. After withdrawing from the vote in the session, the parliamentary group of the Socialist Party has decided to modify at least two of the 33 articles.

Among the proposed amendments, the revised draft includes a minimum requirement for foreign shareholders to hold a minimum of 30% stake in competing companies and/or organisations alongside a mandate for substantial experience in the gambling sector across at least three European countries over a period of no less than three years.

Moreover, adjustments to the re-establishment fund have been proposed, with an increase from the initial allocation of 20 million lek to a minimum of 40 million lek. Additionally, several provisions have been also introduced aiming to limit the influence of betting organizers by prohibiting them from sponsoring sports clubs. Furthermore, the roles of the President of the National Football Federation as well as the President of the Olympic Committee in the Licensing Commission have been eliminated.

Additionally, the proposed legislation act is also trying to strengthen oversight with a new clause that mandates state supervision over the activities of concessionary companies responsible for developing and maintaining the central online monitoring system. This oversight will be carried out by the Licensing Commission through regular audits.

Finally, changes were also made in the articles on the winning rate of national lottery players, which was reduced from 80% to ‘not less than 50%’.

Timor-Leste Emerges as a New Serious, Safe and Secure Online Gambling Jurisdiction

Timor-Leste, one of the strongest democracies in southeast Asia, is taking further strides to become a new jurisdiction in the online betting and gaming sector as complement to regimes in Malta and the Isle of Man.

The Virtual Gaming Association (VGA) of Timor-Leste hosted a special industry event on Friday, February 2, that revealed further details about the proposed regulatory framework.

The VGA will be recommending to the Timor-Leste government that it issues both B2C and B2B licences, regulation be modelled on Malta and the Isle of Man rules and licences be issued in the second or third quarter of this year. It was also confirmed that the VGA will be conducting a consultation process with the industry to further refine its regulatory approach.

“It was a great honour to host an event in London representing Timor-Leste and welcoming President Ramos-Horta as speaker,” the Chairman of the VGA, Richard Leather, said. “Our focus at the VGA is to support Timor-Leste in becoming a jurisdiction that meets and exceeds best practices in online gambling regulation and licensing. Moreover, we look forward to speaking with responsible operators and suppliers looking for a serious, safe and secure jurisdiction for their business.”

Timorese President Jose Ramos-Horta, who was on an official visit to London, spoke at the event about the economic opportunities currently available in Timor-Leste. The country is set to join the Association of Southeast Asian Nations (ASEAN) in 2025 and is currently making efforts to diversify its economy including in the digital and IT sectors with growing interest from investors from around the world.

At the event in London, SoftSwiss and Vittoria Services signed agreements with Capital Group Timor-Leste, which represent the first 120 new jobs in a new business process outsourcing (BPO) project including customer care services set to begin operation in Dili, capital of Timor-Leste, in the next few months.

The BPO, which is currently being fitted out in the newest building in Dili, ETO Tower, includes a training facility where up to 100 operators and supervisors will receive training before being hired.

“This project is particularly important for Timor-Leste, a country in need of more job opportunities for young people and where around 70% of the total population is under 30 years old,” the Chief Operations Officer for Capital Group Timor-Leste, Antonio Sampaio, said. “It represents a significant investment by Capital Group Timor-Leste and also showcases the importance of private sector initiatives towards economic development.”

The Malta Gaming Authority (MGA) has announced that it will be hosting the Annual Conference of the Gambling Regulators European Forum (GREF) in Malta this year.

Taking place between 20-22 May, the prestigious event is set to bring together over 90 representatives from 35 member states to engage in insightful discussions, exchange expertise and cooperate on emerging trends and challenges within the gaming sector.

The Supervisory Board of the Curacao Gaming Control Board (GCB) has elected to appoint Cedric Pietersz (pictured) as its new Managing Director.

On February 1, Pietersz will take up the position of Managing Director, overseeing the current licensing activity under the existing legislation and the transformation process upon enactment of the LOK.

Pietersz joins the GCB following 20 years at the Centrale Bank van Curacao en Sint Maarten (CBCS), serving in several functions including supervision and lastly as part of the management team. The experience gained during his extensive tenure will significantly bolster operational, anti-money laundering (AML) and regulatory compliance as Curacao enters its new jurisdictional era.

“I am honoured to join the Curacao Gaming Control Board at such a dynamic time,” Pietersz said. “I am confident that together with the team and the Supervisory Board we will strategically steer the GCB into a new era while delivering value to all stakeholders including the Minister of Finance.”

SportChamps Fined Again for Flouting Gambling Ad Laws

Online betting operator SportChamps has been fined $17,500 for inducing people to gamble and open a betting account following five previous convictions for similar offences.

SportChamps pled guilty in Downing Centre Local Court to two offences under the Betting and Racing Act following a Liquor & Gaming NSW investigation into advertisements on its website and Facebook pages that stated ‘Punt for free. Learn the game!’ and ‘Receive a free bet each day’.

In New South Wales, it is an offence to publish or offer inducements to open a betting account. Liquor & Gaming NSW Executive Director Regulatory Operations, Jane Lin, said it was unacceptable that SportChamps continued to offend.

“SportChamps has five previous convictions for gambling advertising offences from 2017, 2018, 2020 and 2021,” Lin said. “It’s extremely concerning that this operator has amassed multiple convictions for breaching laws that are in place to protect people from gambling harm.”

For these latest offences, the company tried to attract a new customer base and increase its market share with no regard for the state’s gambling laws. Once an account was created, access was provided to the SportChamps Tournament Betting Lobby webpage, which included access to free and paid gaming tournaments. A deposit icon took users to a page where they were asked to insert credit card details and the deposit amount or they could make direct EFT deposits to SportChamps.

“Wagering operators can legally advertise their products in a variety of ways but they can’t advertise or promote inducements such as offers of increased odds or bonus bets to entice people to open a betting account,” Lin said. “Offences like these have the potential to undermine the entire regulatory framework, which is why we take a zero-tolerance approach to this type of advertising. New South Wales bans the advertisement of any offer of an inducement to participate in a gambling activity including an inducement to bet more frequently.”

It is also prohibited to offer any inducements to open betting accounts, refer friends to open betting accounts, keep a betting account open or consent to receive gambling advertising. A maximum penalty off $110,000 applies to any corporation and $11,000 for individuals who publish prohibited gambling advertising.

IGT Discontinues Appeal Against National Lottery Tender Process

The UK Court of Appeal has granted IGT’s request to dismiss its appeal against its High Court loss in a case challenging the Gambling Commission’s National Lottery tender.

The decision stems from the UKGC’s 2022 decision to award the fourth National Lottery licence to Allwyn Entertainment. This was challenged in court by both Camelot and IGT, who had lodged a rival bid. Camelot had previously been the operator of the National Lottery since its inception in 1994.

After losing a High Court battle in June, Camelot ended legal proceedings. The operator was later acquired by Allwyn from the Ontario Teachers Pension Plan.

However, IGT continued to dispute the tender, appealing the matter to the Court of Appeal where it sought damages from the Commission.

IGT’s decision to withdraw its appeal brings an end to the fraught legal dispute involving the National Lottery tender process, which has been bitterly contested by multiple participants.

“We remain resolute that we have run a fair and robust competition, and that our evaluation has been carried out fairly and lawfully in accordance with our statutory duties,” said the UKGC in a statement.

“Our priority is to continue to work to implement our decision for the benefit of participants and good causes. The Fourth National Lottery Licence is due to be granted on 1 February 2024.”

In the gambling supplier’s High Court challenge to the UKGC, it argued the awarding of the tender to Allwyn represented a violation of Article 1 of the European Convention on Human Rights. This is the section which mandates universal protections under the law.

Overall, IGT argued the allegedly unlawful awarding of the contract to Allwyn led to loss of reputation, goodwill and the ability to win similar contracts.

Curacao is approaching the finishing line of its online gambling reform with the new law being sent to the parliament earlier this week. Markus Bjork at Slotsoo has been in touch with both the Ministry of Finance and several Curacao operators to find out how they feel about this big change. Do European license providers have a reason to feel threatened by Curacao casinos 2.0?

LOK Now Just Waiting for Parliament Approval

On December 19, Curacao’s Ministry of Finance informed that the new law has been officially submitted to the parliament. The National Ordinance for Games of Chance, commonly referred to as LOK (Landsverordening op de kansspelen), is expected to come into effect in the first half of 2024.

Finance Minister Javier Silvania, the front figure of the reform, shares his excitement about this historical moment: “We are very happy to reach this final stage. The submission of the LOK to Parliament is not just a procedural step but a leap towards transformative progress.”

No More Master Licenses or Middle Men

The current setup of the Curacao casino licenses is very unique, with four master license holders being in charge of giving licenses to individual casino operators and ensuring their compliance to the regulations.

This has resulted in big quality differences and if you were to ask ten European Union players how they feel about Curacao casinos you would get very varied replies. Another critique with the current system is that most of the financial gain goes to the four master license holders while the island of Curacao is left with light pockets.

LOK will put an end to master licenses and middle men and require all licenses to be applied directly from Curacao’s Gaming Control Board. This means more uniformed quality and better control. The new law will also require gambling companies to have physical presence on the island, creating new job opportunities for the locals.

The Curaçao casinos we interviewed all welcome the new setup. Spinwise (Tsars Casino) sees some hurdles but says it will be worth it in the long run: “The prohibition of sub-licensing by master licensees introduces a new financial dynamic for individual companies, albeit with associated fees. While adaptation to the new framework may pose short-term challenges, the long-term benefits are expected to outweigh these initial obstacles.”

The Curacao License Will Remain Tax Free

Curacao has been a popular license choice for casino entrepreneurs ever since its conception. Alpha Affiliates’ Chief Legal Officer Alexandra Shepelevich lists the three main benefits of the Curacao license as:

  • No tax on winnings
  • No restrictions on player nationality
  • Strong regulatory framework

Curacao will not try to change this recipe with the new law. The gross profit tax will stay at 0% for all license holders no matter how big or small the revenue is. This is a stark contrast to most licenses in Europe.

A common concern among Curacao operators is that the new system will cause a high barrier for entry, which some see as a positive thing. The new fees for a Curacao casino will be approximately €50,000 a year (annual license fee of €24,600 plus twelve monthly fees of €2,050 and yearly domain fees of €250 each with these numbers based on current ANG/EUR exchange rates).

Another strategy to keep unserious casinos away is the introduction of a digital seal, which will be made available on January 1, 2024. The digital seal is issued by Curacao’s Gaming Control Board and will help players confirm that the website has an active license.

Keeping the Balance Is Crucial for Success

Finance Minister Javier Silvania shares that they had a very inclusive approach when drafting the new law. They consulted all the stakeholders to make sure LOK will consider different perspectives and not just serve one group. The country of Curacao, its citizens, the gambling industry and the players should all benefit from the reform.

Many license jurisdictions that go through a re-regulation fall into the trap of legislating too much, without the government listening to the industry or the players enough. This leads to fewer license holders and lower channelization rates as both the operators and the players search for more attractive solutions from other countries.

All the casinos that we spoke to agree that a good balance between regulations and operational freedom needs to remain. Mark Wellington, Rollino Casino’s Chief Compliance Officer, elaborates this point in his interview with Slotsoo: “One current challenge is maintaining a balance between fostering innovation and ensuring strict compliance with regulatory standards. Striking this balance is crucial to support a dynamic and competitive industry while safeguarding player interests.”

ACMA Reveals Breach of In-play Betting Rules by Top Wagering Companies

The Australian Communications and Media Authority (ACMA) has found the operators of Ladbrokes, Neds, bet365 and Sportsbet to have breached interactive gambling rules.

The operators were said to have used “Fast/Quick Codes” which allow in-play betting on sporting events; under the Interactive Gambling Act 2001 this is not allowed, except under certain circumstances, such as placing the bet over the phone.

Fast/Quick Codes are provided to customers by operators when they use their website or app to build an in-play bet. This Fast/Quick code can be quoted by the customer when they place their bet over the phone along with how much the bet amount is.

In this particular case, the ACMA found that Entain, Hillside and Flutter-owned Sportsbet individually generated Fast/Quick Codes for each particular in-play bet, but that this was done via either the operator’s website or app, not via phone.

Following the investigations, the ACMA has decided for the time being not to take further enforcement action against the operators in question. Indeed, steps have since been taken to ensure their Fast/Quick Codes comply with interactive gambling rules, including being generated before events, meaning they will be generic for all customers.
